Bill Kuchler Artist Commission Agreement

1.  Agreement.  This is an agreement between Bill Kuchler ("the artist") and ___________________________ ("the client") for the creation and transfer of the art work.  All rights and liabilities of either party shall be governed by this agreement.

2.  Description of the work.   The work, to be created by the artist, shall be _____________________________ painted in watercolor, approximately _______ by _______ inches, matted, unframed.

3.  Obligations of the artist and client.

   a)  The artist shall create the work and pay for all necessary materials and supplies.
   b)  The artist shall deliver the work to the client, and shall bear the expenses of crating and shipping the work, if any.
   c)  The client shall be responsible for framing the work.

4.  Start and completion dates.  The artist shall undertake the creation of the work on or about _____________, and shall complete the work by _____________.

5.  Fee and schedule of payments.  The client shall pay to the artist the sum of ___________ in total payment for the work.  The amount of _________ (25% of total) shall be paid at the time this agreement is signed by  both parties.  The balance of __________ (75% of total) shall be paid with client's acceptance of the work.

6.  Acceptance of the work.  If the client is not satisfied with the completed work, the artist shall make reasonable changes in a good faith effort to satisfy the client's objections.  If, following such changes, the client does not accept the work, the artist shall keep any portion of the fee already paid and shall retain ownership of the work.

7.  Commissioned art cannot be returned. Read the "Before you order" section directly below.

Before you order a commission:

a)  Look at my art online: (bluebarnstudio.net) for representations of my stylistic range and capabilities.
b)  Don't order unless you are certain I can provide you what you are looking for.
c)  Understand that the quality of any reference supplied is most important. If no reference is available arrangements    can be made to take digital photos for review and approval (cost to be determined in advance). ______________
   I will interpret what I see in the photo(s) in order to create an accurate, appealing and professional work of art.

8.  Title of ownership.   As a work-for-hire, the client will retain all copyrights to their commissioned work, but the client must allow the artist fair use of the image for artist's own promotional purposes.  Title of ownership of the work shall pass from the artist to the client upon the client's full payment of the artist's fee.
